1.1 The business relationship between Mercedes-Benz High Power Charging Europe GmbH (“Provider”) and the Customer (“Customer”) is governed exclusively by the following General Terms and Conditions (“AGB” or “GTC”) in their version valid at the time of conclusion of the contract. Deviating general terms and conditions of the Customer shall not be accepted unless the Provider expressly agrees to their validity in writing.

1.2 The Customer acts as a consumer if the purpose of the goods and services ordered cannot be attributed primarily to his commercial or self-employed professional activity. Whereas a business person is any natural or legal person or partnership acting in the course of business in concluding the contract.

1.3 These General Terms and Conditions govern the use of Mercedes-Benz Charging Hubs (“GTC”) and the general conditions under which electric vehicles can be charged at the charging points of the stations.

2. Conclusion of the Contract

2.1 To start a charging process, the customer selects the payment method "card payment" on the charging station’s screen to authenticate themselves. The customer then follows the instructions on the payment terminal. After successful authorization, the customer can start the charging process using the button below the charging station’s screen. With the customer's authorization for a charging process, a contract is concluded regarding the charging process between the customer and the Provider.

2.2 The contract is concluded in German. The general terms and conditions are available to the customer in an English translation. In the event of deviations between the German and English versions, the German version has priority.

3. Charging Process; Disponability

3.1 There is no entitlement to a certain charging performance in kW, nor is there any entitlement to complete or proportional charging of the battery in a certain period of time. The charging performance may vary depending on grid stability, station load, and other technical factors.

3.2 The customer can recognize the availability of a charging station by the light bar on the light pole. Blue stands for successful authentication and charging process started, green stands for available and freely usable, red stands for offline or not usable, orange stands for reserved.

3.3 The charging operation ends with unlocking the charging cable.

4. Fee for charging service

4.1 In return for the charging service and the electric power charged, the customer shall pay an amount in money. The fee is calculated based on the price shown on the charging station´s screen when initiating the charging process. All prices include the applicable tax.

4.2 Payment of the purchase price is due immediately upon conclusion of the contract. The charging process only starts after confirmation of the payment method and completion of the respective authorization modalities.

4.3 The payment methods are specified on the credit card terminal.

4.4 Payment by credit or debit card can be made either by card insertion or by contactless payment. The Customer must complete the payment process by entering the personal PIN and where appropriate by completing additional authorizations requested by the credit card provider.

4.5 The customer can request a receipt by selecting the "Receipt" function on the charging station´s screen. The further steps required to receive a receipt are then described on the screen and may be associated with the provision of further personal contact data such as an e-mail address.

5. Use of charging points and obligations of the customer

5.1 The customer shall use the Mercedes-Benz Charging Hub properly and with due diligence. He must ensure a proper cable connection between his vehicle and the charging point. If a customer discovers damage or receives error reports at a charging station or on the charging cable, this charging point may not be used anymore and usage must be terminated immediately. The damage or error must be reported via the hotline specified on the Mercedes-Benz Charging Hub.

5.2 The Customer is only permitted to use a charging point to the extent that is typically associated with charging a BEV (Battery Electric Vehicle) or PHEV (Plugin Hybrid Electric Vehicle) in accordance with the normal consumption and usage behavior of a consumer.

5.3 For reasons of grid stability and due to the use of load management for the purpose of grid-based charging, phased throttling of the charging capacities may occur, and the rated output of the charging points may be temporarily undershot or the charging process may be entirely interrupted. The customer is not entitled to demand the continuation of an interrupted charging process.

6. Liability

6.1 The Provider is exempt from its obligation to provide services as long as and to the extent that recharging points are not available or the power supply to the recharging points is disrupted. Even in the event that the power supply of the charging point is restored, the Provider cannot ensure the resumption of the charging process. The customer is not entitled to demand the continuation of an interrupted charging process.

6.2 Claims of the customer for damages are excluded. This excludes claims for damages on the part of the Customer arising from death or personal injury, health or from breach of material contractual obligations (cardinal obligations) as well as liability for other damages arising from intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract. Otherwise, the following applies. Apart from that, the Provider shall be liable only in the event of intentional or grossly negligent breach of material contractual obligations, such as those which the Operator's contract intends to impose on the basis of its content and purpose or whose fulfillment enables the proper performance of the contract in the first place and on whose compliance the Customer is regularly entitled to trust. This liability is limited to the typical damage foreseeable at the time the contract was concluded.

6.3 Liability is unlimited in the event of death or personal injury. The limitations of liability resulting from 6.1 and 6.2 do not apply if the Provider fraudulently concealed the defect or provided a guarantee for the quality of the service. The same applies if the Provider and the Customer have concluded an agreement on the condition of the service. The provisions of the Product Liability Act remain unaffected.

6.4 The restrictions of 6.1 and 6.2 also apply in favor of the legal representatives and agents of the Provider if claims are asserted directly against them.

6.5 If the Customer breaches these General Terms and Conditions, the Operator is entitled to prohibit the Customer from using the charging points.

7. Legal succession

The Provider is entitled to transfer the rights and obligations arising from this Agreement to a legal successor at any time with the consent of the Customer. The Customer may only refuse consent if there are reasonable concerns about the technical or economic performance of the legal successor. If the operator transfers rights and obligations under this Agreement to a Group company, no consent is required in deviation from sentence 1. This also applies to repeated subsequent legal consequences.

8. Place of Jurisdiction and Applicable Law

The place of jurisdiction is Vienna if the Customer is a business. Otherwise, the legal place of jurisdiction applies. The legal relationship between the Operator and the Customer is governed exclusively by Austrian law, under the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. The legal requirements for restricting the choice of law and the applicability of mandatory regulations, in particular consumer protection legislation, remain unaffected.
